By accessing this website, we assume you accept these terms and conditions in full. 1. User Responsibilities
By using our website, you agree to use it for lawful purposes only. You must not use our website in any way that causes, or may cause, damage to the website or impairment of the availability or accessibility of the website.
2. Product Descriptions
We strive to ensure that our products are described as accurately as possible on our website. However, we do not warrant that the descriptions are accurate, complete, reliable, current, or error-free. If a product offered by us is not as described, your sole remedy is to return it in unused condition.
3. Pricing
All prices are listed in USD and are subject to change without notice. We make every effort to ensure that the pricing on our website is accurate, but errors may occur. If we discover an error in the price of the products you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or canceling it.
(3a) Prices posted on this Site may be different than prices offered by us at any physical locations. All prices, discounts, and promotions posted on this Site are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Price increases will only apply to orders placed after such changes. Posted prices do not include taxes or charges for shipping and handling. All such taxes and charges will be added to your merchandise total and will be itemized in your shopping cart and in your order confirmation email. We strive to display accurate price information, however we may, on occasion, make inadvertent typographical errors, inaccuracies or omissions related to pricing and availability. We reserve the right to correct any errors, inaccuracies, or omissions at any time and to cancel any orders arising from such occurrences.
(3b) We may offer from time-to-time promotions on the Site that may affect pricing and that are governed by terms and conditions separate from these Terms. If there is a conflict between the terms for a promotion and these Terms, the promotion terms will govern.
(3c) The following terms may be used by us to communicate pricing information: (i) “Sale” refers to a reduced price for a product or service.
(ii) “Clearance” refers to a reduced price for a product or service that will be discontinued. (d) Terms of payment are within our sole discretion and, unless otherwise agreed by us in writing, payment must be received by us before our acceptance of an order. We accept credit card payment through Square for all purchases. You represent and warrant that (i) the credit card information you supply to us is true, correct and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honored by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any, regardless of the amount quoted on the Site at the time of your order.
4. Delivery
Clients schedule delivery at checkout. We will make every attempt to deliver within 30 minutes of the requested delivery time. However, we do not offer refunds for late deliveries. Please schedule an appropriate amount of time before your event to ensure timely delivery. We will not leave an order on a doorstep or front porch. These are perishable food products, and someone from your party will need to be at the address and available to accept the order.
5. Returns and Refunds
All catering, charcuterie board orders, and cakes are final and non-refundable. However, we will allow you to change dates or convert to a gift card any deposit balances or pre-payments as long as we have been given at least 72 hours prior to the date of delivery, pickup, or the scheduled event date AND the new date is available AND production for the order has not started. For catering events, please review your contract for specifics relating to your cancellation policy.
6. Disclaimers
To the fullest extent permitted by applicable law, we exclude all representations, warranties, and conditions relating to our website and the use of this website. Nothing in this disclaimer will:
a. limit or exclude our or your liability for death or personal injury resulting from negligence;
b. limit or exclude our or your liability for fraud or fraudulent misrepresentation;
c. limit any of our or your liabilities in any way that is not permitted under applicable law; or
d. exclude any of our or your liabilities that may not be excluded under applicable law.
